Pelushirts.com (hereinafter, the “Website”) is owned and operated by De la Cruz and Associates, Inc. (hereinafter, “De la Cruz” or “Company”), a corporation registered in and under the laws of Puerto Rico.
- ACKNOWLEDGEMENT AND ACCEPTANCE
This Privacy Policy applies to all users of the Website. By using this Website, you signify that you have read, understand, and agree to be bound by (1) the Website’s Terms of Use; (2) the Website’s Privacy Policy; and (3) any documents or clauses incorporated in the Terms of Use and Privacy Policy (collectively, the “Terms”). If you do not agree to any of the Terms, please do not use the Website.
This Privacy Policy explains how we collect, use, and disclose your personal and other information through the Website or through other online and offline interactions. This excludes the sharing of your shipping address with one of our shipping providers, UPS, FedEx, or USPS, in order to ship you your Pelushirt. - INFORMATION COLLECTED BY DE LA CRUZ
De la Cruz collects and stores personal information. Personal information means personally identifiable information, such as your name, physical address, geolocation, mailing address, phone number, email address, and other financial information.
De la Cruz also collects and stores non-personal information. Non-personal information includes your browser type, your internet service provider and its location, the URL of the previous website you visited, your operating system, your IP address, and the date and time you accessed the Website.
- HOW AND WHEN DOES DE LA CRUZ COLLECT INFORMATION
If you communicate with De la Cruz, including through the Website or other online or offline interactions, such as when you sign up for marketing, make purchases, create an account, contact us for customer service or other assistance, and participate in promotions, De la Cruz may collect and store any information that you provide in any such communication. De la Cruz allows you to sign in to the Pelushirt Website using a Facebook account. Facebook sign-on features may also enable you to create an account more easily. Typically, the first time you use Facebook, Facebook will inform you of the information that will be shared with other third parties like De la Cruz. De la Cruz may use that information for purposes described in this Privacy Policy. De la Cruz uses analytic and reporting technologies to record non-personal information, such as web beacons, Cookies, Tracking Pixels, and other similar technologies. A Cookie, for example, is a small file placed on the hard drive of your computer. A web beacon, on the other hand, is an often-transparent graphic image, usually no larger than a 1×1 pixel that is placed on a web page or in an e-mail that is used to monitor the behavior of the user visiting the Website or receiving the e-mail. Tracking pixels are tiny, transparent graphics with a unique identifier, similar in function to cookies, and are used to provide analytical information concerning the user experience as well as to support custom marketing activities for users of the Website. Moreover, De la Cruz does not share your credit card or other account information with unaffiliated third parties unless you authorize us to do so, or if it is necessary to fulfill our responsibilities. As such, we may need to share certain personal information with third party vendors for reasons such as manufacturing, printing, or logistics. The personal information is not provided to these vendors or other third parties for marketing purposes.

De la Cruz will never email you directly and ask for these details unless you have requested help or support.

In addition, if you have provided us with a mobile phone number and we have separately obtained your consent to participate in our SMS campaigns on behalf of ourselves or our affiliated entities, we may use such information.
De la Cruz also uses your non-personal information primarily for insight. This helps De la Cruz understand how the Website’s visitors use De la Cruz’s services and provide a better experience. De la Cruz may also disclose the non-personal information, in aggregate form, to potential strategic partners, advertisers, investors, customers, and others. You may not opt-out of the sharing of this information. However, it cannot be easily used to identify you personally.
De la Cruz reserves the right to disclose the foregoing information to third party governmental agencies or third parties in order to comply with applicable laws, regulations, legal processes or governmental requests (such as to comply with a subpoena or court order), to protect De la Cruz’s rights, or to prevent, protect against, or investigate illegal activities such as credit fraud.
De la Cruz contracts with several partners to help manage, monitor, and optimize its business. De la Cruz also subcontracts with several shipping providers and may also subcontract production, fulfillment, analytics, reporting, and/or other operations. Accordingly, De la Cruz may need to share personal information with these partners so that the partners can provide the services in question. De la Cruz will use commercially reasonable efforts to prevent (but not guarantee) such partners from disclosing your personal information, except for the purpose of providing the services in question.
De la Cruz may also use third party vendors to display relevant ads for Pelushirts or De la Cruz at locations away from the Website on the Internet. In the event De la Cruz goes through a business transition, it reserves the right to transfer any personal and non-personal information to such successor-in-interest.
- CHILDREN’S PRIVACY
The Website is intended for adults. De la Cruz does not knowingly collect personal information from children under the age of 13. However, if the parent or guardian of a child under 13 believes that the child has provided us with personal information, the parent or guardian of that child should contact us if they want this information deleted from our files. If we otherwise obtain knowledge that we have personally identifiable information about a child under 13 in retrievable form in our files, we will delete that information from our existing files.

Please note that, if you decide not to receive marketing emails from De la Cruz, you may still receive “Transactional” email messages regarding your order (i.e. order confirmation, shipping information, customer service notifications, etc.).
